Benefits of Sixth Pay Commission to retirees

A question has been raised in the Parliament regarding the benefits of 6th CPC to the employees who retired before 1.1.2006, the Dopt Minister Shri V.Narayanasamy replied that the orders for implementation of the decision taken by the Government on the recommendations of 6th CPC for revision for pension of past pensioners were issued vide this Department’s Office Memorandum(OM) dated 1.9.2008. The provisions of Para 4.2 of this OM were clarified vide this Department’s letter dated 3.10.2008.

The Central Administrative Tribunal, Principal Bench, New Delhi in its order dated 1.11.2011 observed that by the OM dated 3.10.2008 the original orders of 1.9.2008 have been modified. Hon’ble CAT directed that the past pensioners may be granted, w.e.f. 1.1.2006, a minimum pension @ 50% of the minimum pay corresponding to the pre-revised pay scale with reference to the fitment table applicable for revision of pay of serving employees.

Sixth Pay Commission recommendations in respect of URC employees.

   Demands from various forums have been received for implementation of Sixth Pay Commission recommendations in respect of URC employees, however, these recommendations have not been accepted as URC employees are not government employees.

13th STEERING COMMITTEE (11TH TERM) MEETING OF JCM IIILEVEL COUNCIL OF OFB HELD ON 27.02.2013 AT OFB HQRS, KOLKATTA UNDER THE CHAIRMANSHIP OF DDG/IR. MEMBER/PERS ALSO PARTICIPATED FOR SOME TIME TO HEAR THE VIEWS OF THE STAFF SIDE MMEMBERS.

   Prior to this meeting, Member/Pers, OFB convened a meeting to discuss the co-relation piece work on revised pay of 6th CPC in continuation of the earlier meeting held on 12.12.12. In the last meeting three Federations have strongly objected to any reduction in the job rate/Estimates on account of Co-relation in every pay commission.

   No conclusion could be arrived taking our views Member/Pers discussed with DGOF & Chairman and then convened this meeting with Federation leaders.

OFFICIAL SIDE PROPOSED THE FOLLOWING PROPOSALS

   PROPOSAL – I:  Rs.5200/- PB-I will be the basic pay for SSK, SK, HS II, HS I and MCM without any reduction. This minimum of pay Rs.5200/- will be correlated irrespective of the job and skill.

   PROPOSAL II:  Rs.5200/- PB-1 will be co-related to SSK, SK to HSII & I and for MCM Rs.9300 will be co-related as minimum pay but 70% to 80% will be reduced in the earnings.

   The above two proposals were totally disagreed by the Federations and submitted the following proposals

   PROPOSAL-I:  Semiskilled is going to be abolished. Therefore, Skilled Grade PB-I Rs.5200+1900 GP = Rs7100/- should be fixed as Basic Pay for all the grades upto HIS and for MCM Rs.9300/- should be co-related for piece work without any reduction in Rates/Estimates
   In addition, annual movements and allowances should be paid as separate elements without linking to piece work.

   Further 3 ¼ hours between 44 ¾ and 48 Hrs in a week, piece workers should be paid OT Allowance on Time Wages at par with Day Workers.

   After prolonged deliberations, to contain the cash out go, the following proposal was mutually agreed subject to the approval of DGOF & Chairman in consultation of Finance division/OFB and will be forwarded to M of D

   For Skilled, HS Grd-II Rs.5200 will be taken as minimum of pay for calculating Hourly rate and HS Grd –I for all the correlated piece work

   For MCM Rs.9300/- will be taken as minimum of pay for calculating the Hourly rate.

   The Demand of payment of OT for 3 ¼ hours to Piece workers has to be paid for which a separate case will be submitted to Government of Indian, Ministry of Defence. This has to be approved by Defence Finance, DOP&T, Ministry of Defence. This has to be approved by Defence Finance, DOP&T, Ministry of Finance and finally cabinet has to approve for issue of final orders.

   To reach a Settlement it was unanimously agreed that there will be no reduction in rates/Estimates.

VII CPC : Short Description about Sixth Pay Commission.

Before discuss about the VII pay commission let us see about sixth pay commission…

SIXTH PAY COMMISSION

   Initially the then government refused to set up sixth pay commission to review the pay and allowances of central government employees. The then finance minister told that there was no need to constitute next pay commission since 50 % dearness allowance was already merged with the basic pay. The employees had threatened to go on a nationwide strike if the government failed to set up 6th pay commission. In July 2006, the Cabinet approved setting up of the sixth pay commission. This commission has been set up under the Chairmanship of Justice B.N.Srikrishna with a timeframe of 18 months to submit the report. The cost of hikes in salaries is anticipated to be about Rs. 20,000 crore for a total of 3.5 million government employees. The commission submitted the Report to the Government on March, 24, 2008.

   The Sixth Pay Commission mainly focused on removing ambiguity in respect of various pay scales and mainly focused on reducing number of pay scales .It recommended for removal of Group-D cadre.

   The Fifth CPC had compressed many scales. The number of pay scales was reduced from 51 pay scales as on 31.12.1995 to 34 pay scales by the Fifth CPC. In many cases, this led to the promotion and feeder cadres being placed in an identical pay scale. Although Department of Expenditure issued orders that existence of the feeder and promotion posts in the same pay scale will not constitute an anomaly, however, these orders have consistently been rejected by the various courts of this country. The sixth pay Commission, therefore, decided to evolve a new system of pay scales that would effectively address most of the existing anomalies.

   To remove stagnation, introduction of running pay bands for all posts in the Government presently existing in scales below that of Rs.26,000 (fixed).

   The total number of grades reduced to 20 spread across four distinct running pay bands; one Apex Scale and another grade for the post of Cabinet Secretary/equivalent as against 35 standard pay scales existing earlier.

   Four distinct running pay bands being recommended – one running band each for all categories of employees in groups ‘B ’and ‘C ’with 2 running pay bands for Group A posts.

   Annual increments to be paid in form of three percent of the total of pay in the Pay Band and the corresponding grade pay. The date of annual increments, in all cases, is first of July. Employees completing six months and above in the scale as on July 1 will be eligible.

   The revised pay bands have been implemented retrospectively from 1.1.2006. The Fifth CPC also had recommended implementation of the next Pay Commission’s revised pay scales from 1.1.2006. This was also in consonance with demands of a majority of the Associations of Government employees that had sought implementation of Sixth CPC revised pay scales from 1.1.2006.

   Minimum salary at the entry level of PB-1 pay band is Rs.7000 (Rs.5200 as pay in the pay band plus Rs.1800 as grade pay). Maximum salary at the level of Secretary/equivalent is Rs.80000. The minimum: maximum ratio 1:12. The increase from V CPC to VI CPC in all grades starts from 2.4 times to 3.7 times. The increase ratio between 5th pay commission and 6th pay commission is 1:3
